These terms are a binding agreement between you and Title Sales Pty Ltd (ACN 700 189 788, ABN 94 700 189 788). By using Title Sales you accept them together with our Privacy, Listing, Payment, Refund, Acceptable Use, Content Moderation and Data Deletion policies. You must be at least 18 and able to enter contracts. The service is built for property in Australia.
Title Sales is an advertising platform and a set of software tools for owners selling their own property. We are not a real estate agent, buyer’s agent, auctioneer, conveyancer, valuer or adviser. We do not act for either party, do not negotiate, and never hold deposits or trust money. Offers made through the platform are expressions of interest, not binding contracts: contracts are prepared, exchanged and settled by the parties’ own conveyancers or solicitors. Nothing on the platform, including price estimates and guides, is legal, financial or property advice.
Keep your details accurate and your sign-in secure. You are responsible for activity on your account. One account per person, and accounts are not transferable.
You own the content you post. So that the platform can work, you grant Title Sales a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, adapt for display, publish and promote that content while your listing is live, and to retain sold listings as public sale history afterwards. You promise that you own or have permission to use everything you post, that it does not infringe anyone’s rights, and that it is accurate and not misleading. We may remove content under the Content Moderation Policy.
The Title Sales platform, brand, wordmark, design, software and the compiled arrangement of listings are owned by or licensed to Title Sales. We grant you a personal, non-transferable licence to use the service for buying or selling property. You must not copy, modify, reverse engineer or create derivative works from the platform.
You must not access the platform by automated means, crawl, scrape, harvest, bulk download, frame or republish listings, images or user details, or use them to build or enrich any dataset, mailing list or competing service, without our written permission. Seller contact details are released only to signed-in accounts, the number of listings whose details an account can view each day is limited, and every release is logged. Details obtained through the platform are provided for genuine enquiries about that property only and must not be added to marketing lists or used for unsolicited approaches.
Listings are created by sellers, not by Title Sales, and we do not verify their claims. Nothing on the platform replaces your own due diligence, inspections and professional advice.
We work to keep the platform available but do not promise uninterrupted or error-free operation. We may add, change or withdraw features, and carry out maintenance, at any time.
Nothing in these terms excludes, restricts or modifies any consumer guarantee or right that cannot lawfully be excluded, including under the Australian Consumer Law. Subject to that, the service is provided as is; we do not guarantee that a property will sell, attract enquiries or achieve any price; we are not responsible for the conduct of buyers or sellers or for the outcome of any transaction between them; and our total liability is limited, at our choice, to resupplying the service or refunding the fees you paid us in the previous 12 months. We are not liable for indirect or consequential loss.
You are responsible for claims, losses and costs that arise from your content, your listings or your breach of these terms, and you agree to make good any loss Title Sales suffers as a result.
We may suspend or close accounts that breach these terms or our policies, that we reasonably believe are fraudulent, or that put other users at risk. While an account is suspended its listings are hidden from buyers and it cannot create or edit listings; nothing is deleted. A suspended account holder is notified in the app with the reason, can reply there to explain or dispute the suspension, and a suspension that is lifted restores the account exactly as it was. The Refund Policy governs any amounts paid. You may close your account at any time under the Data Deletion policy.
We may update these terms. The current version is always published here with its effective date, material changes are notified in the app or by email, and continued use after a change takes effect is acceptance of it.
If you use our iOS app: this agreement is between you and Title Sales only, not Apple, and Apple is not responsible for the app or its content. Your licence to use the app is limited, non-transferable and for Apple-branded devices you own or control, subject to the App Store terms. Apple has no obligation to provide maintenance or support. If the app fails to conform to a warranty, Apple may refund the purchase price (if any) and has no other warranty obligation; all other claims are our responsibility. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance and consumer protection claims, or third-party intellectual property claims. You warrant you are not in a country subject to a US Government embargo and are not on any US Government prohibited or restricted party list. Apple and its subsidiaries are third-party beneficiaries of this clause and may enforce it.
Every account has a public profile showing a display name, member number, joining month, listing record, verification badges and reviews. Reviews may only be left by a genuine counterpart, someone with a conversation or offer with you on the listing concerned, must reflect an honest experience of dealing with the member, and must not contain abuse, personal information, or content unrelated to the dealing. New reviews are held for 5 days, during which the reviewed member may accept them (publishing immediately) or challenge them for a moderator’s decision; unchallenged reviews publish automatically when the window closes. We may remove reviews that breach these terms and may suspend accounts that misuse the review system, including retaliatory or bad-faith reviews.
These terms are governed by the laws of Victoria, Australia, and disputes belong to the courts of Victoria. If part of these terms is unenforceable, the rest still stands. Questions: hello@titlesales.com.au.
