Privacy Policy

1. Who we are and what this covers

Title Sales Pty Ltd (ACN 700 189 788, ABN 94 700 189 788) operates the Title Sales website and apps, a marketplace where Australians advertise and sell their own property directly to buyers. This policy explains what personal information we collect, why we collect it, who sees it and the rights you have over it. Personal information means information or an opinion about an identified individual, or one who is reasonably identifiable, and we handle it under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. What we collect

Account details: your email address (sign-in is passwordless), and the contact name, phone number and email you choose to attach to a listing. Sellers toggle each contact channel independently: the phone number and email address can each be revealable or private, direct messages are always available, and a hidden channel is withheld by the platform, not merely hidden on the page. When you message a seller about their listing, the seller can see your first name, your member number and your member profile so they know who they are dealing with; your last name and email address are not shown in conversations; your email address is not shown to them, and a seller’s own email stays behind their reveal setting. Every account also has a public profile showing a display name (drawn from your listings), member number, joining month and year, listing counts, verification badges (whether your email and phone are confirmed, never the address or number itself), and published reviews. If you verify your phone by SMS, the number is stored with your account and used for verification and, where a seller enables it, the listing contact reveal.

Listing content: the property details, photographs, price or sale method, and document links you choose to publish. A listing is public by design and is indexed by search engines.

Activity between users: messages, Expressions of Interest, listing update notifications and reports you send or receive through the platform. We store these to deliver them, to keep a record both parties can rely on, and for safety and moderation. Expressions of Interest include the amount, settlement, finance position, conveyancer and terms you enter; they are shown only to you and the listing owner, and can be withdrawn but not edited.

Payments: processed by Stripe on Stripe-hosted pages. Card numbers never touch Title Sales systems. We keep the transaction record and a Stripe reference.

Safety records: which signed-in accounts requested a listing’s contact details and when, reports you make or that concern you, and, if your account is ever suspended, the suspension record and the messages exchanged about it. These exist to protect sellers from spam and buyers from fraud.

Technical data: device and browser type, IP address, pages viewed and error logs, collected for security, fraud prevention and to make the service work. We use privacy-respecting analytics and do not run third-party advertising trackers.

3. How we collect it

Directly from you when you create an account, list a property, message another user or contact support; automatically from your device when you use the service; and from other users where their messages or offers concern you. We do not buy personal information from data brokers.

4. How we use it

To run the marketplace: publish listings, deliver messages and offers, process payments, produce your listing statistics and campaign reports, keep the platform safe, prevent fraud, meet legal obligations and respond to support requests. Marketing email is sent only with your consent and every message carries a one-click unsubscribe. Service and security messages are sent regardless because the platform cannot run without them.

5. Who we share it with

The providers that run the platform, each receiving only what its function requires: Supabase (database, authentication and photo storage in the AWS Sydney region), Vercel (website hosting), Stripe (payments), Resend (delivery of sign-in codes and notification emails) and Google Workspace (our email).

Address search: when you use Find your address on the listing form, or suburb suggestions in search, the text you type is sent to the Photon geocoding service (built on OpenStreetMap) to return matching Australian addresses. Picking an address stores its coordinates with your listing so it can appear on maps. You can always enter the address manually instead, which sends nothing to the geocoder.

Other users: your listing and display name are public. Your phone and email are never shown publicly: they are released only to signed-in accounts that request them on your listing, each release is limited and logged, and anonymous visitors and automated scrapers cannot obtain them at all. What you write in a message or offer is visible to the person you send it to.

Authorities and other parties where the law requires it, or where necessary to protect users from fraud or harm.

We never sell personal information, never trade it with data brokers, and never build advertising profiles from it.

6. Overseas disclosure

Your data is stored at rest in Australia (Sydney region). Some providers route limited technical data through overseas infrastructure to deliver their service. We take reasonable steps, consistent with Australian Privacy Principle 8, to ensure any overseas handling is consistent with Australian privacy law.

7. Security and retention

Data is encrypted in transit, access is restricted to those who need it, and payment card data never reaches us. We keep personal information while your account is active and for a limited period afterwards where required for legal, dispute or fraud purposes, then delete or de-identify it. Sold listings remain as public sale history, but deleting your account removes your personal contact details from them.

8. Your rights

You can access and correct your details in the app at any time, opt out of marketing with one click, and delete your account and data whenever you choose (see the Data Deletion policy). You may also write to admin@titlesales.com.au to request access to or correction of anything we hold.

9. Complaints

If you believe we have mishandled your personal information, email complaints@titlesales.com.au and we will acknowledge your complaint within 5 business days and work to resolve it promptly. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.

10. Changes to this policy

We update this policy as the service and the law evolve. The current version is always published here with its effective date, and material changes are notified in the app or by email.
