Listing Terms

1. Who may list

Only the owner of a property, or an authorised officer or representative of an owning entity with written authority, may list it. Licensed real estate agents must not advertise client properties on Title Sales. One property per listing, and you must be able to demonstrate your authority to sell if we ask.

Publishing requires ticking the owner declaration presented on the listing form: that you are an owner of the property, whether personally, jointly, or through a company or trust that owns it, that the details in the listing are true, and that you are not a real estate agent acting for a client. The declaration and its time are recorded against the listing.

2. Truth in advertising

Everything in a listing must be true, complete on material points and kept current. Misleading or deceptive conduct in trade is prohibited by the Australian Consumer Law and by these terms. Photographs and video must be of the actual property and yours to use, without another platform’s watermarks, and material facts required to be disclosed in your state must not be concealed.

3. State pre-sale requirements

Before a listing is published you must confirm the pre-sale requirements for your property’s state, which the platform presents at publish time: for example the NSW rule that a contract of sale with the prescribed documents must exist before a residential property is advertised, the Victorian Section 32 vendor statement, Queensland’s Form 2 seller disclosure scheme, the ACT requirement for the contract, reports and Energy Efficiency Rating before offering, and South Australia’s Form 1. Your confirmation is recorded with the listing. These prompts are a plain-language reminder, not legal advice, and your conveyancer or solicitor remains responsible for confirming what applies.

4. Sale methods and status

A listing is offered one of two ways: For Sale, with an advertised price or guide (a price is required), or by Expression of Interest, where no price is advertised and buyers submit structured offers stating their amount, settlement, finance position, conveyancer and terms. Expressions of Interest are not binding offers; nothing binds either party until contracts are exchanged through their conveyancers. Title Sales does not conduct or advertise auctions.

Keep the status current: For Sale, Under Offer or Sold, updated promptly and in any case within 7 days of the change. Marking a listing Under Offer or Sold automatically notifies buyers who saved or enquired about it. Once a listing is marked Sold, contact reveals and new enquiries on it close automatically.

5. Seller updates

You may announce updates on a listing (new inspection times, price changes and similar) to everyone who has saved or enquired about it: one announcement per week on Free, three per week on Plus, five per day on Premium. Announcements also appear publicly on the listing as its updates timeline.

6. Social media boosts

You may order a paid social media campaign for a listing. The price you pay includes the advertising spend and a Title Sales service fee of 15% of the campaign budget, shown before you pay. Campaigns are built from your listing content and go live within 2 business days; a boost is fully refundable until it goes live, and once live the advertising spend is committed.

7. Tiers, duration and pricing

Free listings include up to 3 photos and run for 30 days. Plus ($49) includes 10 photos, insights and a bump, and runs for 120 days. Premium ($99) includes 20 photos, Featured placement, full insights, the Weekly Property Report, the Interested Buyers list and the offers desk, and stays live until sold. An expired listing leaves search and closes its contact channel; nothing is deleted, and it can be brought back from My Listings. Current prices are introductory and may change prospectively; a price change never affects a listing already paid for.

8. Our rights

We decide the ordering of search results and featured placement, may decline or remove listings that break these terms or the Acceptable Use Policy under the Content Moderation Policy, and may make formatting-level corrections. We do not edit the substance of your listing.

9. Payments and refunds

Paid tiers and boosts are charged under the Payment Terms and any refund is handled under the Refund Policy.
